RETURN & CANCELLATION POLICY

1. SCOPE AND APPLICATION

1.1 This Return and Cancellation Policy applies to all educational programmes, courses, and events organised by the IIDRC, including but not limited to:
(a) Educational courses on arbitration, mediation, and alternative dispute resolution;
(b) Certificate programmes and diploma programmes;
(c) Training workshops and skill development programmes;
(d) Conferences, Panel discussions, Conclaves and seminars;
(f) Webinars and online learning programmes;
(g) Any other educational or knowledge-sharing events conducted by IIDRC.

1.2 This Policy governs:

(a) Cancellation of registrations by participants;
(b) Refund of fees paid for programmes and events;
(c) Cancellation or postponement of programmes and events by IIDRC;
(d) Transfer of registrations between participants or programmes.

1.3 This Policy shall be governed by and construed in accordance with the laws of India.

2. DEFINITIONS

For the purposes of this Policy:
2.1 “Participant” means any individual or organisation that has registered and paid for any educational programme or event conducted by IIDRC.
2.2 “Programme Fee” means the total fee payable for enrolment in any educational course, training programme, or event, including registration charges, course fees, material charges, and any other charges specified at the time of registration.
2.3 “Event” means any conference, panel discussion, seminar, workshop, or other gathering organised by IIDRC for knowledge-sharing, networking, or educational purposes.
2.4 “Course” means any structured educational programme, including certificate courses, diploma courses, training programmes, workshops, or learning modules conducted by IIDRC.
2.5 “Commencement Date” means:
(a) For Courses: The date on which the first class, lecture, or learning module is scheduled to begin;

(b) For Events: The date on which the event is scheduled to commence.

3. GENERAL PRINCIPLES

3.1 All registrations are subject to availability of seats and acceptance by IIDRC.
3.2 Once a registration is confirmed by IIDRC, the Participant is bound by the terms of this Policy.
3.3 Cancellation requests must be submitted in writing to IIDRC via email to the official communication address published on the programme or event webpage.
3.4 Refunds, if any, shall be processed only in accordance with the express terms of this Policy. No refund shall be granted outside the terms of this Policy, except at the sole discretion of IIDRC.

4. CANCELLATION BY PARTICIPANT

4.1 Cancellation More Than 30 Days Before Commencement Date
Where a Participant cancels registration more than thirty (30) calendar days before the Commencement Date of the Course:
(a) IIDRC shall return Hundred percent (100%) of the Programme Fee to the Participant (excluding non-refundable payment gateway charges, if any).
4.2 Cancellation Between 15 to 29 Days Before Commencement Date
Where a Participant cancels registration between fifteen (15) to twenty-nine (29) calendar days before the Commencement Date of the Course:

(a) IIDRC shall retain Twenty-fifty percent (25%) of the Programme Fee and Seventy-Fifty percent (75%) of the Programme Fee shall be refunded to the Participant.

4.3 Cancellation Between 14 to 7 Days Before Commencement Date

Where a Participant cancels registration between seven (7) to fourteen (14) calendar days before the Commencement Date of the Course:

(a) IIDRC shall retain Fifty percent (50%) of the Programme Fee and Fifty percent (50%) of the Programme Fee shall be refunded to the Participant.

4.4 Cancellation Less Than 7 Days Before Commencement Date

Where a Participant cancels registration less than seven (7) calendar days before the Commencement Date of the Course:

(a) No refund shall be provided; and the entire Programme Fee shall be retained by IIDRC.

4.5 Cancellation After Commencement of Course

(a) Once a Course has commenced, no cancellation shall be permitted.

(b) Participants who discontinue, withdraw, or fail to attend the Course after commencement shall not be entitled to any refund.

4.6 No-Show or Non-Attendance

(a) Participants who fail to attend the Event without prior cancellation (“No-Show”) shall not be entitled to any refund.
(b) Non-attendance, whether partial or full, shall not constitute grounds for refund.

5. TRANSFER OF REGISTRATION

5.1 Transfer to Another Person
(a) A Participant may request transfer of registration to another person, subject to approval by IIDRC.
(b) Transfer requests must be submitted in writing at least seven (7) calendar days before the Commencement Date.
(d) The transferee must meet all eligibility criteria and requirements for the programme or event.
(e) Once transfer is approved, the original Participant shall have no further claims or rights in relation to the programme or event.
5.2 Transfer to Another Programme or Event

(a) A Participant may request transfer of registration from one programme/event to another programme/event conducted by IIDRC, subject to availability and approval.

(b) Transfer requests must be submitted in writing at least seven (7) calendar days before the Commencement Date of the original programme/event.
(c) Where the Programme Fee of the new programme/event is higher, the Participant shall pay the differential amount.
(d) Where the Programme Fee of the new programme/event is lower, the differential amount shall not be refunded but may be adjusted as a credit towards future programmes at IIDRC’s discretion.
(e) Transfer shall be permitted only once per registration.

6. CANCELLATION OR POSTPONEMENT BY IIDRC

6.1 IIDRC reserves the right to cancel or postpone any programme or event due to:
(a) Insufficient enrolments or registrations;
(b) Unavailability of faculty, speakers, or resource persons;
(c) Technical issues, logistical constraints, or venue unavailability;
(d) Force majeure events, including acts of God, pandemic, natural disasters, civil unrest, government orders, or any circumstance beyond IIDRC’s reasonable control;
(e) If IIDRC cancels an event or course due to operational reasons: Participants will receive a 100% refund of the registration fee (excluding third-party charges), or May opt to transfer their registration to a future session at no additional cost.

6.2 Where IIDRC postpones a programme or event:

(a) Participants shall be notified of the new dates at the earliest opportunity.

6.3 IIDRC shall not be liable for:

(a) Any travel expenses, accommodation costs, visa fees, or other expenses incurred by Participants in relation to the cancelled or postponed programme/event;

(b) Any indirect, consequential, or incidental losses arising from cancellation or postponement;
(c) Any loss of opportunity, business loss, or other intangible losses.

7. REFUND PROCESS AND TIMELINES

7.1 All refund requests must be submitted in writing to IIDRC via email, containing the following information:
(a) Full name of the Participant;
(b) Programme or event name and registration number;
(c) Date of registration and payment reciept;
(d) Amount paid;
(e) Bank account details (account holder name, account number, IFSC code, bank name, branch);
(f) Reason for cancellation;
(g) Supporting documents, if any.

7.2 IIDRC shall acknowledge receipt of the refund request within three (3) working days.

7.3 IIDRC shall process approved refunds within twenty-one (21) working days from the date of receipt of a complete refund request.
7.4 Refunds shall be credited to the bank account from which the original payment was made, or to an alternate bank account nominated by the Participant with appropriate supporting documents.
7.5 Refunds shall be processed through electronic modes such as NEFT, RTGS, UPI or IMPS.
7.6 All refunds shall be net of bank charges, payment gateway charges, or transaction charges, unless IIDRC expressly agrees to bear such charges.
7.7 The actual credit of refund may take up to seven (7) additional working days depending on the banking system and payment infrastructure.

8. DEDUCTIONS FROM REFUNDS

8.1 IIDRC reserves the right to deduct the following from any refund:
(a) Administrative charges and processing fees as specified in this Policy;
(b) Bank charges, payment gateway charges, and transaction charges;
(c) Cost of materials, resources, or services already provided to the Participant;
(d) Taxes and statutory deductions as required by law;
(e) Any amounts due and payable by the Participant to IIDRC under any other obligation.

9. SPECIAL PROVISIONS FOR INTERNATIONAL PARTICIPANTS

9.1 International participants (participants residing outside India) are subject to the same cancellation and refund terms as set out in this Policy.
9.2 All refunds to international participants shall be processed in Indian Rupees (INR) to the bank account from which the original payment was made or to an Indian bank account nominated by the participant.
9.3 Where the original payment was made in foreign currency, the refund shall be calculated based on the exchange rate prevailing on the date of the original payment, and shall be subject to any bank charges, currency conversion charges, or remittance charges.
9.4 IIDRC shall not be liable for any loss arising from currency fluctuations, exchange rate variations, or charges levied by banks or payment intermediaries.

10. FORCE MAJEURE

10.1 IIDRC shall not be liable for any failure or delay in performing its obligations under this Policy due to force majeure events, including but not limited to:

(a) Acts of God, natural disasters, earthquakes, floods, storms, epidemics, pandemics;
(b) War, civil unrest, terrorism, riots, strikes, lockouts;
(c) Government orders, regulatory actions, travel bans, lockdowns;
(d) Technical failures, cyber-attacks, power outages, internet disruptions;
(e) Any other event beyond the reasonable control of IIDRC.

11. DISCRETIONARY POWERS OF IIDRC

11.1 Notwithstanding any other provision of this Policy, IIDRC reserves the absolute and unfettered discretion to:

(a) Waive, reduce, or modify cancellation charges or retention amounts;

(a) Waive, reduce, or modify cancellation charges or retention amounts;

(c) Approve or reject transfer requests;
(d) Extend timelines or condone delays in submitting cancellation requests;

11.2 The exercise of discretion by IIDRC shall be final and binding and shall not create any precedent or entitlement for future cases.

11.3 IIDRC reserves the right to amend this Policy prospectively. The version applicable shall be the version published on the date of registration.

12. LIMITATION OF LIABILITY

12.1 IIDRC’s liability under this Policy shall be limited to the refund of Programme Fees as expressly provided herein.
12.2 IIDRC shall not be liable for:
(a) Any indirect, consequential, special, punitive, or exemplary damages;
(b) Loss of opportunity, loss of profit, loss of business, or reputational loss;
(c) Travel expenses, accommodation costs, visa fees, or other expenses incurred by Participants;
(d) Technical issues, connectivity problems, or platform unavailability affecting online programmes or webinars;
(e) Any claims arising from the content, quality, or delivery of programmes or events, except as expressly warranted by IIDRC;
(f) Any claims arising more than thirty (30) calendar days after the conclusion of the programme or event.

12.3 In no event shall IIDRC’s aggregate liability exceed the Programme Fee paid by the Participant.

13. GOVERNING LAW AND JURISDICTION

13.1 This Policy shall be governed by and construed in accordance with the laws of India.
13. 2 Any dispute arising from this Policy shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996.
