The Institutional and Industrial Dispute Resolution Centre, IIDRC, successfully conducted the fourth session of its ADR Across Industries, Webinar Series, titled “ADR in Banking and Finance, Loan Defaults, Guarantees, Insolvency and Fintech Disputes.” The session was held in an online format and brought together legal practitioners and dispute resolution professionals to examine the evolving nature of financial disputes and the role of alternative dispute resolution mechanisms. The session was moderated by Mr. Asad Saeed, Executive Policy and Communications at Presolv360. The panel featured distinguished speakers including Mr. Rishabh Gandhi, Founder of Rishabh Gandhi and Advocates, Dr. Misha Kumar, Independent Arbitrator and Mediator, Mr. Himanshu Shembekar, Independent Legal Practitioner and Associate Partner, and Ms. Raveena Rai, Counsel at Khaitan and Co.

The discussion focused on the increasing complexity of banking and finance disputes, which now extend beyond traditional lender borrower conflicts to involve multiple stakeholders, including guarantors, creditors, and regulatory bodies. Speakers highlighted the growing intersection of arbitration, insolvency proceedings, and regulatory frameworks, and emphasised the importance of precise drafting of dispute resolution clauses and early stage dispute management to minimise escalation and preserve value.

The session also explored the rise of online dispute resolution in fintech related disputes and the challenges posed by parallel proceedings across multiple forums. IIDRC’s initiative reinforced its role as a neutral ADR institution engaged in sector specific dispute discourse and committed to advancing practical and execution focused approaches to dispute resolution.
